TERMS AND CONDITIONS FOR MEXICO CITY TRIP


PAYMENT TERMS

Full Payment is required to participate. A 50% deposit is required to secure your spot. Payment is to be paid through the online WeTravel platform in USD by credit card or checking account unless otherwise arranged. Full payment must be made on or before 12/15/2018 or you will risk cancellation per the policy below.


CANCELLATION POLICY

Deposit payments include a $1,400 USD non-refundable booking fee (per registrant). This includes $400 as a tax-deductible donation to Co-Lab. Cancellations made prior to November 15 will result in a $775 refund. On or after November 15, there will be no refund, and the full donation amount of $800 will be tax-deductible. Co-Lab will provide written documentation of any donation after it is finally determined. Notice of cancellation must be given in writing. Transfers to another person may be permitted with prior approval. Every effort will be made to refund canceled reservations minus the cancellation fee within 60-days of cancellation.


LIABILITY WAIVER

Secure payment of a reservation confirms your agreement with our liability waiver below. If you cannot or do not wish to agree to and comply with the obligations, exclusions, and limitations of this Liability Waiver you should not make payment and not travel on this excursion, as agreement to and compliance with this Liability Waiver is a condition precedent to Co-Lab’s acceptance of your travel request. Travel Insurance is Required to participate on this excursion and you agree to indemnify and hold Co-Lab and the Co-Lab Project Releasees (as defined below) harmless from and against any and all claims, liabilities, and damages you may have or suffer as a direct or indirect result of your failure to obtain adequate travel insurance.

The individual identified participant desires to participate in activities (“Activities”) organized, sponsored, presented, and/or held by Co-Lab Projects during the dates reserved in and around Mexico City, Mexico. Participant recognizes that there may be various types of Activities during this time period and that participation in the Activities may have risks, including the risk of injury, death, illness, and loss of or damage to personal property.  For and in consideration of the Participant being permitted to participate in the Activities, Participant, his/her spouse (if any), assignees, heirs, parents, guardians, and legal representatives hereby voluntarily indemnify, release from liability, agree to defend and hold harmless Co-Lab Projects, and their officers, trustees, employees, faculty, staff, agents, representatives, and any department, organization or group affiliated therewith (collectively “the Co-Lab Project Releasees”) from any and all claims which may arise from any cause whatsoever, regardless of the source, and for any accident, injury, illness, death, loss, damage to person or property, or other consequences arising or resulting directly or indirectly from participation in the Activities (from the moment you leave your residence and until your return to such residence), including while traveling for the Activities, and including but not limited to claims arising from or related to Co-Lab Projects negligence, if any.

Participant hereby represents and warrants that he/she is and will be covered throughout the Activities by a policy of comprehensive travel, health and accident insurance which provides coverage for injuries and illnesses that Participant sustains or experiences while participating in the Activities. In the event that Participant is injured or suffers an illness of any kind (whether as a result of the excursion or otherwise), Participant agrees to assume any financial obligation, either through Participant’s insurance or through some other means, for any medical costs which Participant incurs. The Co-Lab Projects Releasees assume no responsibility for any medical expenses, direct or indirect expenses or damages, lost wages or other compensation, injury, illness or damage to or loss of personal property suffered by Participant in connection with the Activities or the excursion.

IT IS THE INTENTION OF PARTICIPANT BY RESERVING A SPOT AND TRAVELING WITH CO-LAB AND PAYING ALL OR PART OF THE FEE, S/HE EXPRESSLY ASSUMES ALL RISK OF PERSONAL INJURY OR ILLNESS, DEATH, OR PROPERTY LOSS OR DAMAGE UPON HIMSELF/HERSELF, TO THE EXCLUSION OF THE CO-LAB PROJECTS RELEASEES, AND TO EXEMPT AND RELIEVE  CO-LAB PROJECTS RELEASEES FROM ANY AND ALL LIABILITY FOR PERSONAL INJURY, PROPERTY DAMAGE OR WRONGFUL DEATH.

By agreeing to this release, Participant waives his/her right to bring any legal action now or at any time in the future to recover compensation or obtain any other remedy for any injury to him/her or his/her property or for his/her death, however caused, arising out of his/her participation in the Activities.  Participant agrees that Participant, his/her spouse (if any), assignees, heirs, parents, guardians, and legal representatives will not make any claim against, sue or attach the property of the Co-Lab Projects Releasees for any loss or damage resulting from Participant’s participation in the Activities. Participant further agrees that this release extends to claims and facts unknown and unsuspected to exist at the time of executing this release.

The Participant understands various aspects of the Program, including but not limited to the fact that the Program will be held in and around Mexico City, Mexico. The participant understands that this is travel outside the United States and accepts the risks of such travel. The Participant has received and reviewed the travel itinerary for the Program and understands the risks involved in traveling, to, within and from Mexico City including but not limited to foreign political, legal, social, and economic conditions, language barriers, safety hazards, crime, disease, consumption of food, civil unrest or hostilities, terrorism, war, natural disasters and weather conditions, and negligent first aid operations or medical treatment. Participant further understands that as a Participant s/he ca sustain personal injuries or illness, property loss or damage, or even death as a consequence of or while participating in guided tours, hikes, bus tours, local transportation to and from the Mexico City.

Participant is aware of and understands the risks and dangers associated with any activities which are not associated with the Program controlled by Co-Lab Projects Releasees, such as independent travel during free periods, periods of time extending beyond the termination of the Program, or other periods in which not participating in the Activities.

Co-Lab Projects is not responsible for the loss of or damage to any personal belongings or property during participation in any Activity, including but not limited to the loss of passport, credit cards, cash, luggage, and other items of value or any damage thereto.

Participant is aware of the potential dangers incidental to engaging in the Activities, that this is a release of liability, a waiver of the Participant’s legal right to collect damages in the event of injury, illness death or property loss or damage, and a contract between Participant and the Co-Lab Projects Releasees, and Participant signs it of his/her own free will.  Participant expressly agrees that this release is intended to be as broad and inclusive as the State of Texas will allow and that if any portion is held invalid, agrees that the balance shall, notwithstanding, continue in full force and effect.

If any provision herein is invalid or unenforceable in any jurisdiction, the other provisions herein shall remain in full force and effect in such jurisdiction and the remaining provisions herein shall be liberally construed in order to effectuate the intent of the invalid or unenforceable provision, and the invalidity or unenforceability of any provision herein in any jurisdiction shall not affect the validity or enforceability of any such provision in any other jurisdiction.
